Advisory Opinion Request 2021-10 (Retail Benefits, Inc.) On October 25, the Commission received supplemental material from the requester.

Enforcement

The Commission made public three closed cases, as follows. For more information, see the case documents in the Enforcement Query System.

MUR 7330

COMPLAINANT: American Democracy Legal Fund
RESPONDENTS: Mia Love; Friends of Mia Love and Robert Carlin, in his official capacity as treasurer (the Committee); and Utah Republican Party and Mike Bird, in his official capacity as treasurer (URP)
SUBJECT: The complaint alleged that Love, a 2016 candidate for Utah’s 4th Congressional District, and the Committee coordinated with URP when URP paid for political mailings on behalf of the Committee during the 2016 election cycle, which resulted in the Committee accepting excessive contributions from URP. The complaint further alleged that neither URP nor the Committee properly reported the excessive contributions, and that URP did not report debt to a vendor.
DISPOSITION: The Commission closed the file. Vice Chair Allen Dickerson and Commissioners Sean J. Cooksey and James E. “Trey” Trainor III issued a Statement of Reasons.

MUR 7605

COMPLAINANT: Larry Price
RESPONDENTS: Chad E. Price; and Judson Hill for Congress and Chris D. Clayton, in his official capacity as treasurer (the Committee)
SUBJECT: The complaint alleged that Price made a $2,700 contribution in the name of his mentally disabled adult sister to the Committee in connection with a 2017 Special Election for Georgia’s 6th Congressional District, in which Hill was a candidate.
DISPOSITION: The Commission closed the file. Chair Shana M. Broussard and Commissioners Steven T. Walther and Ellen L. Weintraub issued a Statement of Reasons.

MUR 7832

COMPLAINANT: Anna Paulina Luna for Congress
RESPONDENT: Twitter, Inc. (Twitter)
SUBJECT: The complaint alleged that Twitter made prohibited in-kind contributions to the primary and general election opponents of Anna Paulina Luna, a 2020 candidate for Florida’s 13th Congressional District, because it granted “verification,” a process used to evaluate the authenticity of certain accounts, to the opposing candidates but denied verification to Luna’s account. The complaint alleged that verification is a thing of value because verified accounts reach more users and have higher click-through rates for their fundraising links.
DISPOSITION: The Commission found no reason to believe that Twitter violated the Act by making prohibited corporate in-kind contributions through its process of granting or declining verification and closed the file. Chair Broussard, Vice Chair Dickerson, and Commissioners Trainor, Walther, and Weintraub issued a Statement of Reasons. Vice Chair Dickerson and Commissioner Trainor also issued a separate Statement of Reasons.

Alternative Dispute Resolution

The Commission made public one closed case, as follows. For more information, see the case documents in the Enforcement Query System.

ADR 1027

COMPLAINANT: FEC-Initiated
RESPONDENT: Stronger Foundations, Inc. and Andrew Dipalma, in official capacity as treasurer (the Committee)
SUBJECT: In the normal course of exercising its supervisory responsibilities, the Commission initiated proceedings to determine whether there was reason to believe that the Committee failed to timely file one 48-Hour Report to support four independent expenditures, totaling $121,074, and one 24-Hour Report to support one independent expenditure, totaling $10,500, disclosed on its 2020 July Quarterly Report.
DISPOSITION: The Committee agreed to 1) certify that a representative participated in an FEC training program; 2) develop and certify implementation of a compliance operations manual which include internal controls and a process to track receipt of and response to communications with the Commission; and 3) pay a civil penalty of $6,800.
