Advisory Opinions

Request Received

Advisory Opinion Request 2023-04 (Guy for Congress) On June 12, the Commission made public Advisory Opinion Request 2023-04. Guy for Congress asks whether the candidate, who is a sitting member of Congress, may use campaign funds to pay for the installation of a security feature in his home. The Commission will accept written comments on the request during the 10-day period following publication of the request (no later than June 22) and shall issue a response no later than 60 days after receipt of the complete request, specifically by August 7, 2023.

COMPLAINANT: Dr. Diana Cubbage
RESPONDENTS: Jamie McLeod-Skinner; and Jamie for Oregon and Sue Jackson, in her official capacity as treasurer (the Committee)
SUBJECT: The complaint alleged that Skinner and the Committee failed to include a required disclaimer on yard signs they distributed to supporters. Skinner was a 2022 candidate for Oregon’s 5th Congressional District.
DISPOSITION: The Commission exercised its prosecutorial discretion and dismissed the matter.

Regulations and agency procedures

REG 2023-01 (Use of Artificial Intelligence in Campaign Ads) On June 15, the Commission made public a Draft Notification of Availability of Petition for Rulemaking submitted on May 16, 2023 by Public Citizen. The Petition asks the Commission to specify in regulations or guidance that its statutory provision regarding the fraudulent misrepresentation of campaign authority applies to deliberately deceptive Artificial Intelligence campaign ads.

Proposed Agency Procedure Regarding Litigation Brought Pursuant to 52 U.S.C.§ 30109(a)(8) On June 15, the Commission made public a draft agency procedure that would govern its actions in litigation brought pursuant to 52 U.S.C. § 30109(a)(8).

Litigation

End Citizens United PAC v. FEC (Case No. 22-5176) On June 9, the U.S. Court of Appeals for the District of Columbia Circuit issued a Per Curiam Judgment and Opinion, ordering that the U.S. District Court for the District of Columbia’s judgment be reversed and the case be remanded to the District Court with instructions to return the case to the Commission for further action.

FEC v. Rivera (Case No. 22-11437) On Jun 14, Appellant filed a Brief in the U.S. Court of Appeals for the Eleventh Circuit.

Other election-related resources

Videos on protecting U.S. elections. The FBI’s Protected Voices initiative provides videos designed to help political campaigns protect themselves from foreign influence. The 2019 videos offer guidance on ransomware, business email compromise, supply chain, social media literacy, and foreign influence operations. Other videos, released in 2018, include cyber hygiene topics such as social engineering, patching, router hardening, and app and browser safety.
