Advisory opinions

Extension of time received

Advisory Opinion Request 2017-01 (American Urological Association)

On April 28, the Commission received an Extension of Time until June 15, 2017 on Advisory Opinion Request 2017-01 (American Urological Association). The requestor asks whether it is no longer affiliated with the American Association of Clinical Urologists.

MUR 7066

• COMPLAINANT: Rebecca Neufeld
  
• RESPONDENT: Hillary for America and Jose Villarreal, in his official capacity as treasurer (the Committee)
  
• SUBJECT: The complaint alleged that the Committee accepted excessive contributions. Hillary for America was the principal campaign committee for 2016 Presidential candidate Hillary Clinton.
  
• DISPOSITION: Given the limited scope of the violation, the small amount at issue and the Committee’s remedial actions, the Commission exercised its prosecutorial discretion and dismissed the matter in consideration of Commission priorities.

MURs 7045 and 7047

• COMPLAINANTS: Marie Siebert and Mavis Busiek
  
• RESPONDENTS: Matthew Canovi and Canovi for Congress and Cary Wells, in his official capacity as treasurer (the Committee)
  
• SUBJECT: The complaints alleged that the Committee’s website and campaign literature lacked disclaimers. Canovi appeared on the ballot for the 2016 primary election for Missouri’s 7^th Congressional District, though he did not file a Statement of Candidacy and the Committee did not file a Statement of Organization with the Commission.
  
• DISPOSITION: Given the Committee’s remedial action and the unlikeliness that the general public would have been misled as to who was responsible for the campaign literature or the website, the Commission exercised its prosecutorial discretion and dismissed the matter in consideration of Commission priorities.
  

Litigation 

• CREW v. FEC (Case 1:16-cv-02255-CRC). On April 28, the Commission filed its Answer in the United States District Court for the District of Columbia.
  
• FEC v. Johnson (Case 2:15-cv-00439-DB). On April 27, Defendant Jeremy Johnson filed an Answer to Amended Complaintin the United States District Court for the District of Utah.
  
• Republican Party of Louisiana, et al. v. FEC (Case 16-865). On May 1, Appellants filed a Brief Opposing Motion to Dismiss or Affirm in the United States Supreme Court.
  

Upcoming Commission meetings and hearings

• May 9 and 11: The Commission is scheduled to hold an executive session.
  
• May 11: The previously scheduled open meeting has been canceled.
