FEC COMPLETES ACTION IN EIGHT MATTERS

WASHINGTON -- The Federal Election Commission recently made public its final action on several previous matters under review (MURs). The Commission collected a total of $30,000 in civil penalties in one of the matters described below.

Under the law, the FEC must attempt to resolve its enforcement cases, or Matters Under Review (MURs), through a confidential investigative process that may lead to a negotiated conciliation agreement between the Commission and the individual or group the Commission determines has violated the law.Additional information regarding MURs can be found on the FEC web site at http://www.fec.gov/em/mur.shtml.

MUR 6004

RESPONDENTS:

Friends of Andrew Concannon aka [sic] Concannon for Congress and Raymond Mashni as treasurer (MI-4); and Andrew Donnelly Concannon

COMPLAINANT:

Jeff Timmer; Michigan Republican Party

SUBJECT:

In MUR 6004, the complaint alleged that Friends of Andrew Concannon received contributions and made expenditures in connection with a federal election in Michigan’s 4th Congressional district during 2007 without registering with the FEC and filing disclosure reports, received excessive and prohibited contributions and committed other reporting violations.

OUTCOME:

The FEC found no reason to believe that Friends of Andrew Concannon or Mr. Concannon violated the Federal Election Campaign Act (the Act) because all funds raised were within the Act’s limits and prohibitions and activity prior to registering with the FEC was limited to the “testing-the-waters” assessment of a possible candidacy. The FEC admonished the committee for failing to amend its Statement of Organization properly, using improper disclaimers on communications and failing to report one in-kind contribution.

   

MUR 5637

RESPONDENTS:

21st Century Democrats (527 entity); 21st Century Democrats and Bill Combs as treasurer; and Matthew Entenza

COMPLAINANT:

Republican Party of Minnesota

SUBJECT:

The complaint alleged that 21st Century Democrats, which has both a federal PAC and a nonfederal account, may have used nonfederal donations from Mr. Entenza for federal campaign activities during the 2004 election cycle.

OUTCOME:

The Commission found reason to believe 21st Century Democrats may have violated the Act, but following an investigation determined that no violations occurred and found no reason to believe that Mr. Entenza knowingly made excessive contributions to 21st Century Democrats.

   

MUR 6009

RESPONDENTS:

Sigmon for Congress and David Blanton as treasurer (NC-10); and Hickory Travel & Tours, Inc.

COMPLAINANT:

Rebecca Yount

SUBJECT:

The complaint alleged that Simon for Congress received an impermissible in-kind contribution from a corporation.

OUTCOME:

The matter was dismissed.

   

MUR 5541

RESPONDENTS:

The November Fund and Bill Sittmann as treasurer; Chamber of Commerce of the United States; Tom Donohue; Bush-Cheney ’04, Inc.; and Ken Mehlman

COMPLAINANT:

Citizens for Responsibility and Ethics in Washington

SUBJECT:

The complaint alleged that the November Fund should have registered with the FEC as a PAC in 2004, received prohibited contributions from the Chamber of Commerce of the United States and improperly coordinated activities with Bush-Cheney ’04, Inc.

OUTCOME:

The Commission found no reason to believe that Bush-Cheney ’04, Inc. or Mr. Mehlman violated the Act. The FEC voted to close the file regarding the other respondents.

   

MUR 6011

RESPONDENTS:

Friends of Michael Jackson; Darrell Glasper; and other unknown persons.

COMPLAINANT:

Kenneth H. Hooks

SUBJECT:

The complaint alleged that the respondents initiated fraudulent mass telephone calls in connection with the May 3, 2008, special election in Louisiana’s 6th Congressional district.

OUTCOME:

The matter was dismissed, with the Commission admonishing Mr. Glasper for his apparent failure to include the proper disclaimer on the calls and report them to the FEC as independent expenditures.
   
   

MUR 5517

RESPONDENTS:

Jim Stork for Congress and William C. Oldaker as treasurer (FL-22); Stork Investment (Stork’s Bakery); Stork’s Las Olas, Inc.; and James R. Stork

COMPLAINANT:

Shari L. McCartney

SUBJECT:

The complaint alleged that Mr. Stork’s bakeries made impermissible corporate in-kind contributions to his campaign committee in the form of television ads coordinated with the candidate during Mr. Stork’s 2004 campaign. In addition, Jim Stork for Congress failed to disclose properly advances from the candidate.

OUTCOME:

In a conciliation agreement, the respondents agreed to pay a $30,000 civil penalty.
   

MUR 6022

RESPONDENTS:

SAIC Engineering, Inc., Gerry Connolly for Congress and John Jennison as treasurer (VA-11); Gerald E. Connolly (VA-11); and Robert A. Rosenberg

COMPLAINANT:

Byrne for Congress (VA-11)

SUBJECT:

The complaint alleged SAIC and Robert A. Rosenberg improperly solicited SAIC employees to contribute to Gerry Connolly for Congress and that the Connolly Committee knowingly received prohibited contributions from SAIC. 

OUTCOME:

The FEC found no reason to believe there were any violations.

   

MUR 5415

RESPONDENTS:

Club for Growth Inc. PAC; Club for Growth, Inc.; Pat Toomey for Senate Committee and Jeffrey Zimskind as treasurer (R-PA); and Pat Toomey (R-PA)

COMPLAINANT:

Citizens for Arlen Specter (R-PA)

SUBJECT:

The complaint alleged the Club for Growth coordinated advertising with the Toomey campaign by using a common vendor to create ads.

OUTCOME:

The Commission found no reason to believe Mr. Toomey violated the Act and took no further action against Club for Growth and other respondents.

The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.
