Commission approves interim final rule regarding contributions in the name of another

On May 18, 2023, the Commission approved an interim final rule that removes the prohibition on "knowingly help[ing] or assist[ing] any person in making a contribution in the name of another." Making a contribution in the name of another person remains prohibited under 11 CFR 110.4(b). With the removal of 11 CFR 110.4(b)(1)(iii), the existing paragraph (b)(i)(iv) has been redesignated (b)(1)(iii).

This amendment implements the 2018 order of the United States District Court in FEC v. Swallow, which declared that regulatory provision unlawful and ordered it stricken from the Code of Federal Regulations.

The effective date is August 5, 2023.

Comments must be received on or before June 26, 2023. Commenters are encouraged to submit comments electronically via the Commission’s website at http://sers.fec.gov/fosers, reference REG 2018-06 to ensure timely receipt and consideration.
