DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 5335R:
1. Accept the conciliation agreement as signed by Bill Shehan, Jr., as recommended in the General Counsel?s Report #4 dated February 9, 2005.
2. Close the entire file.
3. Approve the appropriate letters, as recommended in the General Counsel?s Report dated February 9, 2005.
The Commission decided by a vote of 6-0 to take the following actions in MUR 5335R:
1. Accept the conciliation agreement as signed by Richard L. Robinson, counsel for Geoff Davis for Congress and Joe Greene, treasurer, as recommended in the General Counsel?s Report #3 dated December 3, 2004.
2. Approve the appropriate letters, as recommended in the General Counsel?s Report #3 dated December 3, 2004.
3. Close the file as to Geoff Davis for Congress and Joe Greene, treasurer.
The Commission decided by a vote of 5-1 to take the following actions in MUR 5335R:1. Enter into conciliation with Bill Shehan, Jr. prior to a finding of probable cause to believe. 2. Enter into conciliation with Geoff Davis for Congress and Joe Green, as treasurer, prior to a finding of probable cause to believe; and approve the appropriate conciliation agreement with a civil penalty of $1000. 3. Approve the proposed conciliation agreement for Bill Shehan, Jr., as recommended in the General Counsel?s Report dated October 18, 2004. 4. Dismiss the matter against Georgia Shehan and Susan Shehan (a/k/a Suzannah Shehan), and close the file as it pertains to them. 5.Approve the appropriate letters.
Decided by vote 6-0 to 1. Find RTB that Bill Shehan, Jr. knowingly and willfully violated 2 U.S.C. 441a(a)(1)(A) and 441f. 2. Find no RTB that Charles DeLadurantey violated 2 U.S.C. 441a(a)(1)(A) or 441f and close the files as it pertains to this Respondent. 3. Find RTB that the Geoff Davis for Congress Committee and Joe Green, as treasurer, violated 2 U.S.C. 434(b)(3)(A). 4. Find no RTB that Geoff Davis for Congress Committee and Joe Green, as treasurer, violated 2 U.S.C. 441a(f) or 441f. 5. Take no action as to Georgia Shehan and Susan Shehan at time. 6. Approve the Factual and Legal Analyses, as recommended in the First GC Report dated February 6, 2004. 7. Authorize the use of compulsory process, if it becomes necessary, to investigate the matter, including the use of subpoenas duces tecum, interrogatories, and the authority to conduct depositions, directed to Bill Shehan, Jr., Geoff Davis for Congress Committee, Joe Green, as treasurer, and to other witnesses as deemed necessary, as recommended in the First GC Report dated February 6, 2004. 8. Authorize the appropriate letters, as recommended in the First GC Report dated February 6, 2004.
Decided by vote 5-1 to direct the Alternative Dispute Resolution Office to return ADR 126/MUR 5335 to OGC (OGC) for activation as a Matter Under Review and to direct OGC to activate the matter as soon as possible.
