COMMISSION MEETINGS AND HEARINGS

No Commission open meetings or executive sessions were scheduled this week.

ENFORCEMENT

The Commission made public one closed case, as follows. For more information, see the case documents in the Enforcement Query System.

MUR 6767
COMPLAINANT: FEC-Initiated
RESPONDENTS: Central Valley Independent PAC and Ross Allen, in his official capacity as treasurer
SUBJECT: In the normal course of carrying out its supervisory responsibilities, the Commission initiated proceedings to determine whether there was reason to believe that Central Valley Independent PAC and Allen, in his official capacity as treasurer (the Committee), failed to file in a timely manner a 24-hour report disclosing $166,391 in independent expenditures.
DISPOSITION: The Commission entered into a conciliation agreement providing for the Committee to pay a civil penalty of $4,800.

ALTERNATIVE DISPUTE RESOLUTION

The Commission made public one campaign finance enforcement matter that was resolved through its Alternative Dispute Resolution (ADR) program, as follows. For more information, see the case documents in the Enforcement Query System.

ADR 709  – Nevada State Democratic Party and Jan Churchill, in her official capacity as treasurer. The respondent agreed to (1) certify that a representative participated in an FEC conference, (2) develop and certify the distribution of procedures to identify and report debts and obligations and (3) pay a civil penalty of $3,800.

LITIGATION

Independence Institute v. FEC (Case 1:14-cv-01500-CKK). On September 19, the Commission filed its Memorandum of Law in Opposition to Plaintiff''''s Motion for Preliminary Injunction in the United States District Court for the District of Columbia.  On September 22, the Campaign Legal Center, Democracy 21 and Public Citizen, Inc. filed a Brief Amici Curiae in Support of the Commission and in Opposition to Plaintiff''''s Motion for Preliminary Injunction

Parsons, et al. v. FEC (Case 1:14-cv-01265). On September 23, the Commission filed an Unopposed Motion to Dismiss in the United States District Court for the District of Columbia.  On September 23, the Court ordered the case dismissed without prejudice for lack of standing.

Public Citizen, et al. v. FEC (Case 1:14-cv-00148-RJL). On September 19, the Center for Competitive Politics filed a Brief of Amicus Curiae in Support of the Commission in the United States District Court for the District of Columbia.

Rufer, et al. v. FEC (Case 1:14-cv-00837-CRC). On September 22, the United States District Court for the District of Columbia issued an Order on Plaintiffs’ Motion for Partial Reconsideration and Clarification of Denial of Motion for Three-Judge Panel

Rufer, et al. v. FEC (Case 1:14-cv-00837-CRC) and Republican National Committee, et al. v. FEC (Case 1:14-cv-00853-CRC). On September 22, the United States District Court for the District of Columbia issued a Certification Order, certifying the constitutional questions and findings of fact to the en banc United States Court of Appeals for the District of Columbia.

Stop Reckless Economic Instability caused by Democrats, et al. v. FEC (Case 1:14-cv-00397-AJT-IDD). On September 19, the Commission filed its Motion for Summary Judgment and plaintiffs filed their Motion for Summary Judgment in the United States District Court for the Eastern District of Virginia.

Wagner v. FEC (Case 12-5162). Oral argument is scheduled for September 30 in the United States Court of Appeals for the District of Columbia Circuit. 

RULEMAKING AND AGENCY OPERATIONS

Petition for Rulemaking from The National Convention PBC. On September 25, the Commission made public a petition for rulemaking from the National Convention PBC and approved for publication in the Federal Register a Notice of Availability for the Rulemaking Petition. The petition requests that the Commission conduct a rulemaking proceeding to revise its regulations to include delegates to a constitutional convention within the definition of "federal office."

OUTREACH

September 22 – 26, Mexico City, Mexico.  Deputy Press Officer Christian Hilland attended the Seventh Inter-American Electoral Training Seminar. The seminar focused on “Accessibility and Electoral Participation.” 

September 24 -25, Chairman Lee E. Goodman visited Elizabethtown College in Pennsylvania as part of its 2014-2015 Ernest Lefever Visiting Fellow program. Chairman Goodman visited classes, met with students and delivered a public lecture on the role and responsibilities of the FEC, as well as the importance of the First Amendment in guiding the agency''''s work.
