Reporting recount donations

November 24, 2020

Funds raised and spent by a candidate or state party committee to pay recount expenses resulting from the general election are subject to the amount limitations, source prohibitions and reporting requirements of the Act, but are not “contributions” or “expenditures.” Recount funds may only be used for recount-related activities, which include disbursements for contesting election results.

A federal campaign may establish a recount fund either as a separate bank account of the candidate’s authorized committee or as a separate entity.
