Presidential Campaign Cited for Failure to File Disclosure Report

PRESIDENTIAL CAMPAIGN CITED FOR FAILURE TO FILE DISCLOSURE REPORT

WASHINGTON ‑‑ The Federal Election Commission has cited a presidential campaign committee for failure to file a required monthly financial disclosure report.

As of 5 p.m., June 4, 2004, a disclosure report from the following committee had not been filed:

SHARPTON 2004....ANDREW A. RIVERA, TREAS...REV ALFRED C. SHARPTON...DEM

The report was due May 20, and should have detailed financial activity from April 1, 2004 through April 30, 2004. Presidential candidates who accept public funding must file their reports electronically. The disclosure report should have been filed by midnight, May 20, 2004.

On May 27, 2004, the committee was notified by mailgram that the FEC had not received the monthly report. The campaign had four business days from the date of the mailgram to respond. Failure to file by June 4, 2004 resulted in this publication. Prior notification of the required filing was sent to the committee on March 22.

Further Commission action against non-filers and late filers is decided on a case-by-case basis. Federal law gives the FEC broad authority to initiate enforcement actions and the FEC has implemented a new administrative fine program which will subject committees to penalties ranging from $30 to $16,000 or more.

The next regularly scheduled disclosure report for presidential committees will be the June monthly report, due June 20. It will cover activity from May 1 through May 31.
