WASHINGTON -- The Federal Election Commission has recently made public its final action on a matter previously under review (MUR). This release contains only disposition information.

1. MUR 5276  
     
  RESPONDENTS: Friends of Jack Machek, Raymond Machek, treasurer
  COMPLAINANTS: Valerie M. Martin
  SUBJECT: Failure to accurately report loan; failure to file disclosure reports electronically; failure to file amended Statement of Organization; candidate loans from other than personal funds
  DISPOSITION:

The complaint contends that the candidate committee failed to accurately report loans made by the candidate to the committee. If they had properly reported those loans then the committee would have exceeded the $50,000 threshold thereby triggering the electronic filing requirement. The complaint also alleges that the Candidate may have used funds other than personal funds to make loans to the Committee. The Commission found that the Committee had failed to file an amended Statement of Organization when it changed treasurers. The Commission also found the Committee failed to list the specific loan incurrence dates in Schedule C of its Quarterly Report. The Commission found there was no reason to believe that the committee was required to file reports electronically, as it appeared that they did not meet the threshold for electronic filing. The Commission found there was no reason to believe the candidate used funds other than his own to make loans to the committee.

The complaint alleges that VIEW PAC and Pryce Project, by virtue of their relationship to Representative Pryce, are affiliated, failed to report their affiliation, and made and received contributions that exceeded a shared limit. The complaint similarly alleges that eight federal candidate committees received excessive aggregate contributions from the two political action committees. The Commission found there was no reason to believe that any of the respondents violated the Act.

*There are four administrative stages to the FEC enforcement process:

1. Receipt of proper complaint 3. ?Probable cause? stage
2. ?Reason to believe? stage 4. Conciliation stage

It requires the votes of at least four of the six Commissioners to take any action. The FEC can close a case at any point after reviewing a complaint. If a violation is found and conciliation cannot be reached, then the FEC can institute a civil court action against a respondent.
