SUBJECT: Reporting
DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR 8348:1. Accept the signed conciliation agreement with 1199 SEIU United Healthcare Workers East Federal Political Action Fund and Helen Schaub in her official capacity as treasurer, as recommended in the Memorandum to the Commission dated February 11, 2025.2. Approve the appropriate letter.3. Close the file effective 30 days after the certification of this vote is signed (or on the next business day after the 30th day, if the 30th day falls on a weekend or a holiday).
The Commission decided by a vote of 6-0 to take the following actions, subject to the Notice of Errata dated October 23, 2024, in AR 24-01:1. Open a Matter Under Review.2. Find reason to believe that 1199 SEIU United Healthcare Workers East Federal Political Action Fund and Helen Schaub in her official capacity as treasurer violated 52 U.S.C. § 30104(b)(4)(H)(iii) and 11 C.F.R. § 104.4(a) by failing to disclose independent expenditures on Schedule E of its disclosure reports.3. Find reason to believe that 1199 SEIU United Healthcare Workers East Federal Political Action Fund and Helen Schaub in her official capacity as treasurer violated 52 U.S.C. § 30104(g)(1) and 11 C.F.R. § 104.4(c) by failing to report independent expenditures. 4. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated October 11, 2024, reinsert at page 3, note 9 “As noted by the Referral, the amounts for these two IEs were incorrectly included on Schedule B of the Committee’s disclosure reports and were part of Finding 2(a). Id. The Committee’s failure to file 24-Hour Reports are encompassed by Finding 2(b). Id.”5. Enter into pre-probable cause conciliation with 1199 SEIU United Healthcare Workers East Federal Political Action Fund and Helen Schaub in her official capacity as treasurer. 6. Approve the Conciliation Agreement, as recommended in the First General Counsel’s Report dated October 11, 2024, subject to a recalculation of the penalty at 100% of the administrative fines schedule.7. Approve the appropriate letter.
The Commission failed by a vote of 3-3 to take the following actions, subject to the Notice of Errata dated October 23, 2024, in Audit Referral 24-01:1. Open a Matter Under Review.2.
