DISPOSITION: The Commission failed by a vote of 3-3 to:
a. Dismiss the allegation that Susan Collins and Collins for Senator and Elizabeth McCandless in her official capacity as treasurer violated 52 U.S.C. § 30116(a)(8) and 11 C.F.R. § 110.6(c)(2) by failing to report a conduit that forwarded earmarked contributions and send a letter of caution.
b. Dismiss the allegation that Susan Collins and Collins for Senator and Elizabeth McCandless in her official capacity as treasurer violated 52 U.S.C. § 30104(i) and 11 C.F.R. § 104.22(b) by failing to file reports disclosing bundled contributions and send a letter of caution.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated May 13, 2021.
d. Close the file.
e. Approve the appropriate letters.
The Commission decided by a vote of 4-2 to:
a. Dismiss the allegation that Susan Collins and Collins for Senator and Elizabeth McCandless in her official capacity as treasurer violated 52 U.S.C. § 30116(a)(8) and 11 C.F.R. § 110.6(c)(2) by failing to report a conduit that forwarded earmarked contributions.
b. Dismiss the allegation that Susan Collins and Collins for Senator and Elizabeth McCandless in her official capacity as treasurer violated 52 U.S.C. § 30104(i) and 11 C.F.R. § 104.22(b) by failing to file reports disclosing bundled contributions.
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated May 13, 2021, subject to the edits circulated by Commissioner Walther’s Office on August 5, 2021 at 2:04 p.m.
d. Close the file.
e. Approve the appropriate letters.
