DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 7690:1. Accept the signed conciliation agreement, as recommended in the Memorandum to the Commission dated December 2, 2024.2. Dismiss the allegation that 1820 PAC and Thomas Datwyler in his official capacity as treasurer violated 11 C.F.R. § 103.3(b)(2) by failing to refund the Society of Young Women Scientists and Engineers LLC’s $150,000 contribution.3. Approve the appropriate letters.4. Close the file as to all Respondents effective 30 days from the date the certification of this vote is signed (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).

The Commission decided by a vote of 5-0 to find probable cause to believe that the Society of Young Women Scientists and Engineers LLC knowingly and willfully violated 52 U.S.C. § 30122, as recommended in the Memorandum to the Commission dated September 12, 2024.
The Commission decided by a vote of 6-0 to take the following actions in MUR 7690:1. Rescind the Commission’s finding of reason to believe that PacMar Technologies, LLC, f/k/a Navatek LLC, knowingly and willfully violated 52 U.S.C. § 30119 by making contributions as a government contractor to Collins for Senator.2. Approve the Conciliation Agreement, as recommended in the Memorandum to the Commission dated June 28, 2024.
The Commission decided by a vote of 6-0 to:a. Substitute the name PacMar Technologies, LLC, f/k/a Navatek LLC, in place of “unknown persons” in the Commission’s previous findings that “unknown persons” violated 52 U.S.C. § 30122.b. Find reason to believe that PacMar Technologies, LLC, f/k/a Navatek LLC knowingly and willfully violated 52 U.S.C. § 30122 by making a contribution in the name of the Society of Young Women Scientists and Engineers LLC to 1820 PAC.c. Find reason to believe that the Society of Young Women Scientists and Engineers LLC knowingly and willfully violated 52 U.S.C. § 30122 by permitting its name to be used to effect a contribution in the name of another to 1820 PAC.d. Dismiss the allegation that Jennifer Lam violated 52 U.S.C. § 30122 in connection with the contribution from the Society of Young Women Scientists and Engineers LLC to 1820 PAC and close the file as to her.e. Find reason to believe that PacMar Technologies, LLC, f/k/a Navatek LLC, knowingly and willfully violated 52 U.S.C. § 30119 by making contributions as a government contractor to 1820 PAC and to Collins for Senator.f. Enter into conciliation with the Society of Young Women Scientists and Engineers and PacMar Technologies, LLC.i. Approve the draft conciliation agreement for the Society of Young Women Scientists and Engineers, as recommended in the Second General Counsel’s Report dated May 30, 2024.j. The Commission decided by a vote of 6-0 to amend motion #3 as follows:In the Factual and Legal Analysis proposed to be approved by the motion, substitute, consistent with 11 C.F.R. § 110.4, the term “true contributor” for “true source” wherever it appears.
The Commission failed by a vote of 3-3 to:a. Open a new Matter Under Review.b. Sever from MUR 7690 and place in the new MUR all allegations regarding contributions by Navatek, LLC, Clifford Chen, and Lawrence Lum Kee to Collins for Senator.c. In the new MUR find reason to believe that: i. Clifford Chen and PacMar Technologies, LLC, f/k/a Navateck LLC, knowingly and willfully violated 52 U.S.C. § 30122 by making contributions in the names of individual family members to Collins for Senator. ii. PacMar Technologies, LLC, f/k/a Navatek LLC, knowingly and willfully violated 52 U.S.C. § 30119 by making contributions as a government contractor to Collins for Senator. iii. PacMar Technologies, LLC, f/k/a Navateck LLC, violated 52 U.S.C. § 30118 by making a corporate contribution or 11 C.F.R. § 110.1(g)(5) by failing to provide attribution information to Collins for Senator. iv. Lawrence Lum Kee violated 52 U.S.C. § 30118 by consenting to make a prohibited corporate contribution or 52 U.S.C. § 30116(a) by making an excessive contribution to Collins for Senator. v. Clifford Chen knowingly and willfully violated 52 U.S.C. § 30116(a) by making excessive contributions to Collins for Senator.d. In the new MUR, approve the Factual and Legal Analysis with respect to PacMar Technologies, LLC, as recommended in the Second General Counsel’s Report dated May 30, 2024, subject to the edits circulated by Commissioner Broussard’s Office on June 26, 2024, at 7 p.m.e. In the new MUR, approve the Factual and Legal Analyses with respect to Clifford Chen and Lawrence Lum Kee, as recommended in the Second General Counsel’s Report dated May 30, 2024.f. In the new MUR, approve the Proposed Conciliation Agreement with respect to Clifford Chen, as recommended in the Second General Counsel’s Report dated May 30, 2024.g. Approve the Subpoena and Order to determine whether PacMar Technologies, LLC, f/k/a Navatek LLC, was structured for tax purposes as a corporate LLC or partnership LLC when it made contributions in the name of another to Collins for Senator.h. Approve the appropriate letters.
