SUBJECT: Reporting
DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MURs 7409 and 7620:
1. Accept the conciliation agreement in MURs 7409 and 7620 with Mason Tenders District Council of Greater New York and LI PAC and Mike Prohaska in his official capacity as treasurer, as recommended in the Memorandum from the Acting General Counsel dated August 26, 2019.
2. Approve the appropriate letter.
3. Close the file.
The Commission failed by a vote of 2-2 to:
a. Open a MUR in RR 17L-24.
b. Find reason to believe that Mason Tenders District Council of Greater New York & LI PAC and Mike Prohaska in his official capacity as treasurer violated 52 U.S.C. § 30104(b).
c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated February 2, 2018.
d. Enter into conciliation with Mason Tenders District Council of Greater New York & LI PAC and Mike Prohaska in his official capacity as treasurer prior to a finding of probable cause to believe.
e. Approve the conciliation agreement, as recommended in the First General Counsel’s Report dated February 2, 2018.
f. Approve the appropriate letter.
