COMPLAINANT:

DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 7226:
1. Dismiss, as a matter of prosecutorial discretion, the allegation that Pawlowski2016.com and Lisa Pawlowski in her official capacity as treasurer failed to disclose a debt in violation of 52 U.S.C. § 30104(b)(8) and 11 C.F.R. § 104.3(d).
2. Dismiss, as a matter of prosecutorial discretion, the allegation that Pawlowski2016.com and Lisa Pawlowski in her official capacity as treasurer violated 52 U.S.C. § 30104(b) by failing to accurately report the purpose of the $76,500 disbursement.
3. Take no further action with respect to Michael Fleck’s violations of 52 U.S.C. §§ 30102(b)(3) and 30114(b).
4. Dismiss the allegations that Nicola Bulgari made prohibited foreign national contributions in connection with the use of vehicles, in violation of 52 U.S.C. § 30121.
5. Dismiss the allegations that Edwin Pawlowski and Pawlowski2016.com and Lisa Pawlowski in his official capacity as treasurer received prohibited foreign national contributions in connection with the use of vehicles, in violation of 52 U.S.C. § 30121.
6. Dismiss the allegations that Pawlowski2016.com and Lisa Pawlowski in her official capacity as treasurer violated 52 U.S.C. § 30104(b) by failing to report prohibited foreign national contributions.
7. Approve the appropriate letters.
8. Close the file.
The Commission decided by a vote of 4-0 to approve the subpoena for deposition, and subpoena for documents and order to submit written answers to Michael Fleck, as recommended in the Memorandum from the Acting General Counsel dated
November 8, 2018.
The Commission failed by a vote of 2-3 to:
a. Open a MUR.
b. Find reason to believe that Pawlowski2016.com and Lisa Pawlowski in her official capacity as treasurer violated 52 U.S.C. § 30104(b).
c. Find reason to believe that Michael Fleck knowingly and willfully violated 52 U.S.C. §§ 30102(b)(3) and 30114(b).
d. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated December 21, 2016.
e. Authorize the use of compulsory process, as necessary.
f. Approve the appropriate letters.
The Commission decided by a vote of 5-0 to:
a. Open a MUR.
b. Take no action at this time against Pawlowski2016.com and Lisa Pawlowski in her official capacity as treasurer . . . REDACTED . . . .
c. Find reason to believe that Michael Fleck knowingly and willfully violated 52 U.S.C. §§ 30102(b)(3) and 30114(b).
d. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated December 21, 2016.
e. Authorize the use of compulsory process, as necessary.
f. Approve the appropriate letters.
