DISPOSITION: The Commission failed by a vote of 3-3 to:
1. Find reason to believe that Make America Great Again PAC, f/k/a Donald J. Trump for President, Inc., and Bradley T. Crate in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(8) and 11 C.F.R. § 104.3(d) by failing to accurately disclose its debts and obligations.
2. Find no reason to believe that Make America Great Again PAC, f/k/a Donald J. Trump for President, Inc., and Bradley T. Crate in his official capacity as treasurer violated 11 C.F.R. § 102.9(e)(1) by failing to employ acceptable accounting methods to distinguish between contributions received for different elections.
3. Dismiss the allegation that Donald J. Trump violated 52 U.S.C. § 30102(e) by failing to timely file his Statement of Candidacy.
4. Dismiss the allegation that Make America Great Again PAC, f/k/a Donald J. Trump for President, Inc., and Bradley T. Crate in his official capacity as treasurer violated 52 U.S.C. § 30103(a) by failing to timely file its Statement of Organization.
5. Approve the relevant sections of the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated July 13, 2021.
6. Enter conciliation with Make America Great Again PAC, f/k/a Donald J. Trump for President, Inc., and Bradley T. Crate in his official capacity as treasurer prior to a finding of probable cause to believe.
7. Approve the proposed Conciliation Agreement, as recommended in the First General Counsel’s Report dated July 13, 2021.
8. Approve the appropriate letters.
The Commission failed by a vote of 3-3 to:
1. Find reason to believe that Make America Great Again PAC, f/k/a Donald J. Trump for President, Inc., and Bradley T. Crate in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b) and 30116(f) by knowingly accepting and failing to properly report contributions received after the 2016 general election in excess of the Trump Committee’s net debts outstanding.
2. Find reason to believe that Trump Make America Great Again Committee and Bradley T. Crate in his official capacity as treasurer violated 52 U.S.C. § 30116(f) and 11 C.F.R. § 102.17(c)(6)(i) by knowingly accepting and allocating contributions after the 2016 general election in excess of the Trump Committee’s net debts outstanding.
3. Direct the Office of General Counsel to draft an appropriate Factual and Legal Analysis.
4. Approve compulsory process.

1. Dismiss the allegations pursuant to Heckler v. Chaney.
2. Issue appropriate letters.
3. Close the file.
