SUBJECT: Reporting
DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MURs 7001, 7002, 7003, 7009 and 7455:
1. Accept the conciliation agreement with Ted Cruz for Senate, as recommended in the Memorandum from the Acting General Counsel dated January 30, 2019.
2. Approve the appropriate letters.
3. Close the file.
The Commission failed by a vote of 2-2 to:
a. Open a Matter Under Review in RAD Referral 16L-09.
b. Find reason to believe that Ted Cruz for Senate and Bradley Knippa in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(3)(E) and 11 C.F.R. § 104.3(d)(4).
c. Find no reason to believe that Senator Cruz violated 52 U.S.C. § 30104(b)(3)(E) and 11 C.F.R. § 104.3(d)(4).
d. Authorize conciliation with Ted Cruz for Senate and Bradley Knippa in his official capacity as treasurer, prior to a finding of probable cause to believe.
e. Approve the Factual and Legal Analysis for Ted Cruz and Ted Cruz for Senate, as recommended in the First General Counsel’s Report dated May 24, 2018 and as last circulated by the Offices of Commissioners Hunter and Petersen on Tuesday, July 17, 2018 at 4:28 p.m.
f. Approve the proposed Conciliation Agreement, as recommended in the First General Counsel’s Report dated May 24, 2018.
g. Approve the appropriate letters.
