DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR 6824: 1. Accept the signed joint conciliation agreement with Eugene Chin Yu, Eugene Yu for Congress, Inc. and Jonie H. Yu, as recommended in the Memorandum from the Acting General Counsel dated August 27, 2019. 2. Accept the signed conciliation agreement with Wayne B. Brown, as recommended in the Memorandum from the Acting General Counsel dated August 27, 2019. 3. Approve the appropriate letters. 4. Close the file in MUR 6824. 5. Close the file in ADR 701.
The Commission decided by a vote of 4-0 to: a. Approve the revised proposed joint conciliation agreement with Eugene Chin Yu, Eugene Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer and Jonie H. Yu, as circulated in an email by the Office of General Counsel on March 28, 2019 rather than the conciliation agreements recommended in the Second General Counsel’s Report dated March 12, 2019. b. Approve the revised proposed conciliation agreement with Wayne B. Brown, as circulated in an email by the Office of General Counsel on March 28, 2019 rather than the conciliation agreements recommended in the Second General Counsel’s Report dated March 12, 2019.
The Commission decided by a vote of 4-0 to: Reconsider the vote to approve recommendations 7 and 8 of the Second General Counsel’s Report.

Find reason to believe that Eugene Chin Yu and Eugene Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer violated 52 U.S.C. § 30116(f) for accepting excessive contributions. b. Find reason to believe that Wayne B. Brown violated 52 U.S.C. § 30116(a)(1)(A) for making excessive contributions. c. Find reason to believe that Jonie H. Yu violated 52 U.S.C. § 30116(a)(1)(A) for making excessive contributions. d. Take no action as to WayneWorks, LLC. e. Authorize pre-probable cause conciliation with Eugene Chin Yu, Eugene Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer, Jonie H. Yu, and Wayne B. Brown, prior to a finding of probable cause to believe. f. Approve the Factual and Legal Analyses to Eugene Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer, Eugene Chin Yu and Jonie H. Yu and to Wayne B. Brown, as recommended in the Second General Counsel’s Report dated March 12, 2019. g. Approve the proposed joint conciliation agreement with Eugene Chin Yu, Eugene Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer and Jonie H. Find reason to believe that Eugene Chin Yu and Eugene Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer violated 52 U.S.C. § 30116(f) for accepting excessive contributions. b. Find reason to believe that Wayne B. Brown violated 52 U.S.C. § 30116(a)(1)(A) for making excessive contributions. c. Find reason to believe that Jonie H. Yu violated 52 U.S.C. § 30116(a)(1)(A) for making excessive contributions. d. Take no action as to WayneWorks, LLC. e. Find reason to believe that Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b) and 30116(f) (formerly 2 U.S.C. §§ 434(b) and 441a(f)). b. Find reason to believe that Eugene Chin Yu violated 52 U.S.C. § 30116(f) (formerly 2 U.S.C. 441a(f)). c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 5, 2014. d. Authorize the use of compulsory process, including interrogatories and subpoenas, as necessary. e. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to: a. Find reason to believe that Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer violated 52 U.S.C. § 30104(b). b. Take no action at this time with respect to the allegations that Yu for Congress, Inc., and Donnie Miller in his official capacity as treasurer and Eugene Chin Yu violated 52 U.S.C. § 30116(f). c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 5, 2014, as revised and circulated by Commissioner Goodman’s Office on December 14, 2015 at 6:47 P.M. d. Authorize the use of compulsory process, including interrogatories and subpoenas, as necessary. e. Approve the appropriate letters. f. Authorize technical and conforming edits to the Factual and Legal Analysis.
