DISPOSITION: The Commission decided by a vote of 4-0 to take the following actions in MUR 6721:
1. Take no further action against Beth Steele, Women AdvocatingRespect, Todd Long, and Todd Long for Congress and Todd Long in his official capacity as treasurer.
2. Approve the appropriate letters.
3. Close the file.
The Commission decided by a vote of 6-0 to:
1. Find reason to believe that Todd Long, Todd Long for Congress and Todd
Long in his official capacity as treasurer violated 52 U.S.C. §§ 30104(b),
30116(f), and 30120(a)(1)-(3).
2. Approve the Factual and Legal Analysis last circulated by Vice Chairman
Petersen’s Office on August 12, 2015 at 5:45 P.M. and as further
modified at the Table with the additional following edits: . . . REDACTED . . .
3. Approve compulsory process, as necessary.
4. Approve the appropriate letters.
The Commission decided by a vote of 5-1 to:
1. Authorize the Office of General Counsel to name as respondents Todd Long and Todd Long for Congress and Todd Long in his official capacity as treasurer.
2. Authorize the Office of General Counsel to notify Todd Long and Todd Long for Congress and Todd Long in his official capacity as treasurer of the complaint and any relevant information learned in the Commission’s ongoing investigation and provide them an opportunity to respond prior to the Office of General Counsel making any further recommendations that there is reason to believe additional violations occurred.
The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Beth Steele violated 2 U.S.C. § 434(c), 2 U.S.C. § 434(g), and 11 C.F.R. § 109.10(d) by not filing an independent expenditure report within 24 hours of making independent expenditures over $1,000 for the WAR robocalls.
b. Find reason to believe that Women Advocating Respect violated 2 U.S.C. § 441d(a) and 11 C.F.R. § 110.11(a)(2) by not including a complete and accurate disclaimer in a robocall.
c. Authorize the use of compulsory process.
d. Approve the Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated August 12, 2013.
e. Approve the appropriate letters.
The Commission decided by a vote of 6-0 to:
a. Find reason to believe that Beth Steele and Women Advocating Respect violated 2 U.S.C. § 434(c), 2 U.S.C. § 434(g), and 11 C.F.R. § 109.10(d) by not filing an independent expenditure report within 24 hours after apparently
making independent expenditures over $1,000 for Women Advocating Respect robocalls.
b. Authorize a limited investigation to discern the amount of the expenditure at issue.
c. Approve the Factual and Legal Analysis as recommended in the First General Counsel’s Report dated August 12, 2013, subject to the following:
(1) As previously circulated and as revised and circulated at the dias among the Commissioners on December 3, 2013.
(2) Authorize the Office of General Counsel to make any necessary technical and conforming edits.
