ADVISORY OPINIONS

Request Received

AOR 2012-35 (Global Transaction Services Group, Inc.). On October 25, the Commission made public Advisory Opinion Request 2012-35. Global Transaction Services Group, Inc. (GTSG), a technology company, asks whether its proposed method of processing anonymous electronic credit and debit card contributions to candidates via text messaging is permissible under the Federal Election Campaign Act of 1971, as amended, (the Act) and Commission regulations. GTSG requests expedited consideration of its request pursuant to the Commission''''s Advisory Opinion Procedure. The Commission must issue a response no later than 60 days after the receipt of the complete request, specifically by December 24, 2012.

ENFORCEMENT

The Commission made public two closed cases. For more information, see the case documents in the Enforcement Query System.

MUR 6536
COMPLAINANT: Sylvia N. Murphy
RESPONDENTS: Gonzalez for Congress Committee and Lisa P. Gonzalez, in her official capacity as treasurer
SUBJECT: The complaint alleged that Gonzalez for Congress Committee and Gonzalez, in her official capacity as treasurer, (the Committee) failed to disclose disbursements or in-kind contributions for office space in three locations. Roberto Gonzalez was a 2012 primary candidate for Texas’s 14th Congressional District.
DISPOSITION: The Commission exercised its prosecutorial discretion and dismissed the matter in light of the small amount potentially at issue and in light of the Committee’s request for permission to terminate.

MUR 6587
COMPLAINANT: FEC-Initiated
RESPONDENTS: United Association Political Education Committee and William P. Hite, in his official capacity as treasurer
SUBJECT: In the normal course of carrying out its supervisory activities, the Commission found that the United Association Political Education Committee and Hite, in his official capacity as treasurer, (the Committee) (1) improperly disclosed independent expenditures based on the date paid rather than the date disseminated and (2) failed to file corresponding 24- or 48-hour notices for these expenditures and accurately report them on Schedule E.
DISPOSITION: The Commission found reason to believe that the Committee failed to file 24-hour and 48-hour notices in a timely way and failed to properly disclose independent expenditures. The Commission entered into a conciliation agreement, whereby the Committee agreed to pay a civil penalty of $39,000.

ALTERNATIVE DISPUTE RESOLUTION

The Commission made public two campaign finance enforcement matters that were resolved through its Alternative Dispute Resolution (ADR) program.

ADR 616 – Frack Action USA PAC. The respondent agreed to (1) work with Commission staff to terminate the committee and (2) pay a civil penalty of $1,000.

ADR 620 – National Association of Professional Employer Organizations, the National Association of Professional Organizations PAC and Thom Stohler, in his official capacity as treasurer. The respondent agreed to (1) implement compliance measures and (2) send a representative to an FEC conference.
