COMMISSION MEETINGS AND HEARINGS

ADVISORY OPINIONS
Request Received AOR 2012-35 (Global Transaction Services Group, Inc.). On October 25, the Commission made public Advisory Opinion Request 2012-35. Global Transaction Services Group, Inc. (GTSG), a technology company, asks whether its proposed method of processing anonymous electronic credit and debit card contributions to candidates via text messaging is permissible under the Federal Election Campaign Act of 1971, as amended, (the Act) and Commission regulations. GTSG requests expedited consideration of its request pursuant to the Commission''''s Advisory Opinion Procedure. The Commission must issue a response no later than 60 days after the receipt of the complete request, specifically by December 24, 2012. ENFORCEMENT

ALTERNATIVE DISPUTE RESOLUTION
The Commission made public two campaign finance enforcement matters that were resolved through its Alternative Dispute Resolution (ADR) program.
ADR 616 – Frack Action USA PAC. The respondent agreed to (1) work with Commission staff to terminate the committee and (2) pay a civil penalty of $1,000.
ADR 620 – National Association of Professional Employer Organizations, the National Association of Professional Organizations PAC and Thom Stohler, in his official capacity as treasurer. The respondent agreed to (1) implement compliance measures and (2) send a representative to an FEC conference.

LITIGATION
Free Speech v. FEC (District Court Case 2:12-cv-00127-SWS; Circuit Court Case 12-8078). On October 19, the plaintiff filed a Notice of Appeal and a Motion for Injunction Pending Appeal in the United States District Court for the District of Wyoming; and the United States Court of Appeals for the Tenth Circuit issued a Notice of Docketed Appeal. On October 23, the Commission filed its Opposition to Plaintiff''''s Motion for Injunction Pending Appeal in the District Court. On October 24, the appellant filed a Motion for Emergency Injunction on Appeal in the Appeals Court, and the Appeals Court issued an order directing the Commission to file a response to the emergency motion for injunction. Also on October 25, the District Court issued an Order Denying Motion for Injunction Pending Appeal.
Hassan v. FEC (Case 11-cv-02189-EGS). On October 24, the plaintiff filed a Notice of Appeal in the United States Court of Appeals for the District of Columbia Circuit.
James v. FEC (Case 1:12-cv-01451-JEB-JRB-RLW). On October 22, the Commission filed its Opposition to Plaintiff''''s Response to Order to Show Cause in the United States District Court for the District of Columbia.
Tea Party Leadership Fund, et al. v. FEC (Case 1:12-cv-1707-RWR) On October 22, the United States District Court for the District of Columbia issued an Order to Show Cause. On October 25, the plaintiffs filed a Response to Order to Show Cause. Also on the same day, the Commission filed its Response to Court’s Order to Show Cause. OUTREACH
On October 23, Vice Chair Ellen L. Weintraub discussed campaign finance law, presidential public funding, and Commission operations with a group of journalists from Yemen as part of the State Department''''s International Visitor Leadership Program.
On October 24, Vice Chair Weintraub discussed Commission operations with a group of election officials, journalists, and academics from the Asia/Pacific region as part of the State Department''''s International Visitor Leadership Program. Under the aegis of the same program, Vice Chair Weintraub also spoke about campaign finance law with a group of election officials, journalists and academics from Iraq and the impact of Citizens United v. FEC with a group of political leaders and academics from Malaysia.
On October 25, Vice Chair Weintraub met with two groups from the Middle East and Africa taking part in the International Visitor Leadership Program.
On October 26, Communications Specialist Travis Drake discussed the role and operations of the Commission with a group of government leaders from India as part of the International Visitor Leadership Program.
CAMPAIGN FINANCE REPORTS

October 30: The Commission is scheduled to hold an executive session.
November 1: The Commission is scheduled to hold an open meeting.
December 12: On Wednesday, December 12, 2012 at 10:00 a.m., the Commission will hold a public hearing to discuss several key issues related to its enforcement process, including issues relating to the documents that were released to the public recently. Any general questions and comments related to the documents can be sent to Documents_Feedback@fec.gov.
