ENFORCEMENT The Commission made public four closed cases. MUR 6302 – Joe Cantrell; Joseph Henry Cantrell, Jr.; and Joe for Congress and J.H. Cantrell, Jr, in his official capacity as treasurer. The Commission exercised its prosecutorial discretion and dismissed the case.
MUR 6321 – Mark Reed for Congress and Norman Paul Devereaux, in his official capacity as treasurer; and Mark Steven Reed. The Commission exercised its prosecutorial discretion and dismissed the case.
MUR 6327 – John Russell “Russ” Carnahan; Carnahan in Congress and Lawrence Giesing, in his official capacity as treasurer; and Castle Ballroom Development, LLC. The Commission exercised its prosecutorial discretion and dismissed the case.
MUR 6329 – Michael Grimm; and Michael Grimm for Congress and Wayne T. Muratore, in his official capacity as treasurer. The Commission exercised its prosecutorial discretion and dismissed the case.

ALTERNATIVE DISPUTE RESOLUTION The Commission made public two campaign finance enforcement matters that were resolved through its Alternative Dispute Resolution (ADR) program. ADR 550 – Gibbs for Congress and Jody Gibbs, in her official capacity as treasurer. The Commission dismissed the case. ADR 541 – The Committee to Elect Alan Grayson and Paul Ashcraft, in his official capacity as treasurer. The respondents agreed to implement compliance measures and pay a civil penalty of $3,000. The Commission approved issuance of and made public one Audit Report. A summary of the findings is below.
Biden for President, Inc. On December 2, the Commission approved the Final Audit Report on Biden for President, Inc., covering campaign finance activity between December 15, 2006 and April 30, 2008. The Commission found that the candidate did not receive matching fund payments in excess of his entitlements. In addition, the Commission found that Biden for President, Inc. (“BFP”) failed to resolve a material number of excessive contributions totaling $106,216. For a separate category of apparent excessive contributions totaling $1.09 million however, the Commission concluded that there was information to show that BFP had sent redesignation letters but did not satisfy recordkeeping requirements connected with the redesignation. Other findings concerned the receipt of one corporate in-kind contribution, stale dated checks and the disclosure of disbursements, debts, and obligations.
