COMMISSION MEETINGS AND HEARINGS No Commission open meetings or executive sessions were scheduled this week. ADVISORY OPINIONS Drafts AO 2013-18 (Revolution Messaging, LLC). On November 26, the Commission made public two drafts of Advisory Opinion 2013-18 in response to a request from Revolution Messaging. The requestor asks whether the proposed mobile phone banner advertisements are exempt from the disclaimer requirement of the Federal Election Campaign Act of 1971, as amended. Comments on the drafts are due by noon on December 4. AO 2013-19 (Yamaha Motor Corporation, U.S.A.). On November 26, the Commission made public two drafts of Advisory Opinion 2013-19 in response to a request from Yamaha Motor Corporation, U.S.A. The requestor asks whether it may solicit contributions to its separate segregated fund from the executive and administrative personnel of the dealers and service centers that sell and service Yamaha''''s marine products, and from such dealers and service centers that are individuals or partnerships. Comments on the drafts are due by noon on December 4. ENFORCEMENT The Commission made public one closed case and one Statement of Reasons, as follows. MUR 6621 ADMINISTRATIVE FINES The Commission made public six campaign finance enforcement matters that were resolved through its Administrative Fines (AF) program, as follows. For more information, see the case documents in the Enforcement Query System. AF 2591 – Modica for Senate and Julien Modica, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $10,725. AF 2714 – Jesse Jackson, Jr. for Congress and Vickie Pasley, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $7,150. AF 2718 – Kenneth Sanders for Congress Committee and the Office of the Treasurer. The Commission made a final determination and assessed a civil penalty of $1,237. AF 2720 – Lamar Sternad for Congress and Justin Lamar Sternad, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $1,237. AF 2728 – Modica for Senate and Julien Modica, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $12,512. AF 2738 – Wilson 2012 and Mary F. Graetzer, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $113. ALTERNATIVE DISPUTE RESOLUTION The Commission made public three campaign finance enforcement matters that were resolved through its Alternative Dispute Resolution (ADR) program, as follows. For more information, see the case documents in the Enforcement Query System. ADR 642– Hardworking Americans Committee and Randall Thompson, in his official capacity as treasurer. The respondent agreed to (1) develop and certify implementation of compliance measures, (2) send a representative to an FEC conference, (3) and pay a civil penalty of $2,000. ADR 644– Freedom and Liberty PAC and Michael D. Edmunds, in his official capacity as treasurer. The Commission closed the file. ADR 657– American Jobs and Growth Alliance and David W. Staudt, in his official capacity as treasurer. The respondent agreed to (1) send a representative to an FEC conference, (2) and pay a civil penalty of $1,750. LITIGATION Combat Veterans for Congress PAC v. FEC (Case 1:11-cv-02168 (CKK)).On November 26, the plaintiffs filed a Notice of Appeal to the United States Court of Appeals for the District of Columbia Circuit.
