COMMISSION MEETINGS AND HEARINGS

On March 12 and 14, the Commission held executive sessions.

The open meeting previously scheduled for this week was cancelled.

COMPLAINANT: FEC-Initiated
RESPONDENT: Committee to Re-Elect Trent Franks to Congress and Lisa Teschler, in her official capacity as treasurer
SUBJECT: In the normal course of carrying out its supervisory responsibilities, the Commission found that the Committee to Re-Elect Trent Franks to Congress and Teschler, in her official capacity as treasurer, (the Committee) failed to disclose $299,800.71 in debt and $11,923.28 in disbursements in seven reports filed with the Commission in 2010 and 2011. Franks was a 2010 and 2012 candidate for Arizona’s 8th Congressional District.
DISPOSITION: The Commission entered into a conciliation agreement providing for the Committee to pay a civil penalty of $14,000.

AUDITS

Final Audit Report of the Commission on Randy Hultgren for Congress.  On March 13, the Commission made public the Final Audit Report of the Commission on Randy Hultgren for Congress, covering campaign finance activity between September 22, 2009 and December 31, 2010. The Commission approved a finding related to the misstatement of financial activity.

LITIGATION

FEC v. Craig for U.S. Senate(Case 1:12-cv-00958-ABJ). On March 11, the United States District Court for the District of Columbia heard oral argument on the defendants’ motion to dismiss.

Free Speech v. FEC (Case 12-8078). Oral argument is scheduled for May 7 in the United States Court of Appeals for the Tenth Circuit.

Hassan v. FEC (Case 1:11-cv-02189-EGS).  On March 11, the United States Court of Appeals for the District of Columbia Circuit issued its Per Curiam Order.

Van Hollen v. FEC (Case 1:11-cv-00766-ABJ). On March 12, the Court issued a Minute Order Lifting the Stay.

Wagner v. FEC (Case 12-5365). On March 11, the Plaintiffs-Appellants filed a Corrected Reply Brief.  Oral argument is scheduled for May 16 in the United States Court of Appeals for the District of Columbia Circuit.
