COMMISSION MEETINGS
No Commission Executive Sessions or Open Meetings were scheduled this week.
ADVISORY OPINIONS Drafts AO 2011-11 (Colbert).On June 23, the Commission made public two drafts of Advisory Opinion 2011-11. Stephen Colbert proposes to establish an "independent expenditure-only political committee" and asks if the value of resources provided to the proposed political committee by U.S. subsidiaries of Viacom, Inc. would be covered by the media exemption. Comments on the drafts are due by 5:30 PM on June 28, 2011. AO 2011-12 (Majority PAC and House Majority PAC). On June 23, the Commission made public a draft of Advisory Opinion 2011-12. Majority PAC and House Majority PAC ("the PACs") ask whether federal candidates, federal officeholders, and officers of national party committees may solicit unlimited individual, corporate, and union contributions on behalf of the independent expenditure-only political committees without violating 2 U.S.C. 441i. The PACs also ask, if the answer to the first question is no, whether federal candidates, federal officeholders, and officers of national party committees may participate in fundraisers for the PACs at which unlimited individual, corporate, and union contributions are raised, provided that the covered officials do not solicit such contributions by complying with 11 CFR 300.64. The Commission made public 28 campaign finance enforcement matters that were resolved through its Administrative Fines (AF) program.
AF 2165 – Eric Wnuck 2010 and Eric Wnuck, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $3,850.
AF 2197 – Bob Turner for Congress and Kevin P. Turner, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $2,725.
AF 2198 – Butler Snow Political Action Committee and Lucien Bourgeois, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $250.
AF 2200 – Committee to Elect Roderick Vereen for Congress and Chuck Mogbo, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $756.

AUDITS
The Audits for the 1978 Election Cycle have been added to the FEC website under the Title 26 Audit Reports and Unauthorized Committees categories. Also refer to the website for general information about final Audit Reports. Audits are organized in three categories: Authorized Committees, Unauthorized Committees, and Title 26 Audit Reports.
LITIGATION
Schonberg v. FEC (No. 1:10-cv-02040 (RWR)). On June 23, the United States District Court for the District of Columbia issued its order and opinion. The court dismissed all claims against the Commission and the United States. Plaintiff Steve Schonberg challenged the constitutionality of provisions of the Act, the Bipartisan Campaign Reform Act of 2002, the statute governing representational allowances for Members of the House of Representatives and legislation commonly referred to as “earmarks.”
CREW v. FEC (No. 11-cv-00951(CKK)). On June 23, the Commission filed a motion to dismiss or, in the alternative, motion for summary judgment in United States District Court for the District of Columbia. CREW alleges that the Commission failed to respond to a Freedom of Information Act request for records relating to three Commissioners, pursuant to 5 U.S.C. 552.
Van Hollen v. FEC (No. 1:11-cv-00766 (ABJ )). On June 21, the Commission filed its answer to the complaint in the United States District Court for the District of Columbia. Representative Chris Van Hollen challenges as contrary to law a Commission regulation concerning disclosure of electioneering communications, 11 C.F.R. 104.20(c)(9).
