Advisory opinions

Advisory Opinion Request 2016-05 (Huckabee for President)

On June 16, the Commission held over discussion of a draft responding to an advisory opinion request from Huckabee for President, Inc. The requestor, the principal campaign committee for former presidential candidate Mike Huckabee, asks whether a separate legal defense fund may be used to pay the amount the Committee has agreed to pay in settlement of a copyright infringement lawsuit.

Litigation

• CREW, et al. v. FEC (Case 1:16-cv-00259-BAH). On June 13, Plaintiffs filed a Memorandum in Opposition to Commission’s and Crossroads GPS's Motions to Dismiss in the United States District Court for the District of Columbia.

Outreach

• On June 15, Commissioner Ellen L. Weintraub met with American University students to discuss the role and work of the Commission, as well as recent developments in campaign finance law.
• On June 16, Commissioner Ann M. Ravel was keynote speaker at the Women Lawyers Section of the Santa Clara County Bar Association''''s Lean In Seminar in Palo Alto, CA.

Rulemaking and agency procedures

REG 2016-02 Civil Monetary Penalties Inflation Adjustments Interim Final Rules

On June 16, the Commission approved interim final rules to adjust for inflation the civil monetary penalties established under the Federal Election Campaign Act of 1971, as amended (the Act), the Presidential Election Campaign Fund Act, and the Presidential Primary Matching Payment Account Act.

Proposed Statement of Policy Regarding the Public Disclosure of Closed Enforcement Documents

On June 16, the Commission discussed a proposed statement of policy that would expand the range of records to be made publicly available on a regular basis.

Proposed Revisions to Forms 3, 3P, 3X, 6 and Instructions

On June 16, the Commission held over discussion on proposed revisions to several campaign finance reporting forms and their accompanying instructions.

FEC Email Management Policy

On June 16, the Commission held over discussion of the agency’s email retention policy.

Additional research materials about the agency, campaign finance information, and election results are available through the Library section of the Commission website.

The 2016 edition of the Combined Federal State Disclosure and Election Directory is available in the Public Records section of the Commission website. This publication identifies the federal and state agencies responsible for the disclosure of campaign finances, lobbying, personal finances, public financing, candidates on the ballot, election results, spending on state initiatives and other financial filings.
