COMMISSION MEETINGS AND HEARINGS

ADVISORY OPINIONS

Request Received

AOR 2012-23 (Snake River Sugar Company). On July 2, the Commission made public Advisory Opinion Request 2012-23.  Snake River Sugar Company (Snake River) is an incorporated agricultural cooperative that purchases sugar beets from growers and is the connected organization for Snake River PAC, a separate segregated fund. Snake River and seven regional growers'''' associations (the Associations) ask (1) whether the Associations are "trade associations" under the Federal Election Campaign Act of 1971, as amended, (the Act) and Commission regulations; (2) whether the Associations and Snake River are affiliated for purposes of the Act and Commission regulations; and (3) whether the Associations may solicit contributions to Snake River PAC from the shareholders and executive and administrative personnel, and their families, of their incorporated members. The Commission will accept written comments on the request during the 10-day period following publication of the request (no later than July 12, 2012) and issue a response no later than 60 days after receipt of the complete request, specifically by August 24, 2012.

ALTERNATIVE DISPUTE RESOLUTION

The Commission made public six campaign finance enforcement matters that were resolved through its Alternative Dispute Resolution (ADR) program.

ADR 563 – Tennessee Republican Party Federal Election Account and Frank Colvett, in his official capacity as treasurer. The respondent agreed to (1) send a representative to an FEC conference, (2) implement compliance measures and (3) pay a civil penalty of $30,000.

ADR 581 – Senate Conservatives Fund and Barry Wynn, in his official capacity as treasurer. The respondent agreed to pay a civil penalty of $2,000.

ADR 583 – Americans for New Leadership and Brent Husson, in his official capacity as treasurer. The respondent agreed to (1) implement compliance measures and (2) pay a civil penalty of $2,000.

ADR 585 – Kansas Republican Party and T.C. Andersen, in his official capacity as treasurer. The respondent agreed to (1) implement compliance measures and (2) pay a civil penalty of $6,500.

ADR 587 – National Emergency Medicine PAC and Phyllis Edans, in her official capacity as treasurer. The respondent agreed to (1) implement compliance measures, (2) send a representative to an FEC conference and (3) pay a civil penalty of $2,000.

ADR 609 – John Kennedy for U.S. Senate, Inc., and Keith Davis, in his official capacity as treasurer. The respondent agreed to (1) work with Commission staff to terminate the Committee and (2) pay a civil penalty of $2,376.

LITIGATION

Shaun McCutcheon, et al. v. FEC (No. 12-cv-01034 (JEB, JRB, RLW)). On July 3, the Court of Appeals for the District of Columbia Circuit issued a Designation of Judges to Serve on Three-Judge Court.
