ADVISORY OPINIONS

Comment Received

AOR 2013-11 (Citizens for Joe Miller). On August 28, the Commission received a comment on Advisory Opinion Request 2013-11 (Citizens for Joe Miller/the Committee). The Committee is an authorized committee of Joseph W. Miller, a former federal candidate for Senate from Alaska.  The Committee asks whether it can use campaign funds as a deposit with an Alaska state court pending an appeal of an Alaskan judgment assessing attorney''''s fees in litigation involving Mr. Miller.

Requests Received

AOR 2013-13 (Freshman Hold''''em JFC). On August 28, the Commission made public Advisory Opinion Request 2013-13 from the Freshman Hold''''em Joint Fundraising Committee, Stutzman for Congress, Gardner for Congress 2012, Tom Reed for Congress, Denham for Congress, Benishek for Congress, Inc., Rodney for Congress, Duffy for Congress, Chris Gibson for Congress, Friends of Joe Heck, Friends of Dave Joyce, Pat Meehan for Congress, Scott Rigell for Congress, Rothfus for Congress, Jon Runyan for Congress, Inc., VoteTipton.com, Valadao for Congress, and Walorski for Congress Inc. Joint Fundraising Committee.  The requestors ask whether Freshman Hold’em JFC may use its shorter name and its URL in its required disclaimers, rather than the committee''''s full name.  The Commission must issue a response no later than 60 days after receipt of the complete request, that is, by October 28, 2013.

AOR 2013-14 (Long). On August 20, the Commission made public Advisory Opinion Request 2013-14. Martin Long for Congress asks whether it may distribute campaign materials that include a reference to the candidate’s book. The Commission must issue a response no later than 20 days after receipt of the complete request, that is, by September 13, 2013, because this request was submitted by a federal candidate within 60 days before a federal election.

ALTERNATIVE DISPUTE RESOLUTION

The Commission made public one campaign finance enforcement matter that was resolved through its Alternative Dispute Resolution (ADR) program, as follows. For more information, see the case documents in the Enforcement Query System.

ADR 647 – Democratic Party of Illinois and Michael Kasper, in his official capacity as treasurer. The respondent agreed to (1) retain an outside consultant to review its compliance procedures and conduct training, (2) develop and certify implementation of compliance measures (3) send a representative to an FEC conference, and (4) pay a civil penalty of $3,500.

LITIGATION

Tea Party Leadership Fund, et al. v. FEC (Case 1:12-cv-1707-KBJ-AK). On August 26, the United States District Court for the District of Columbia issued a Memorandum Order.

PUBLIC DISCLOSURE

On August 23, the Office of Inspector General made public its report, Review of Outstanding Recommendations as of June 2013.
