COMMISSION MEETINGS AND HEARINGS

• On February 7 and 9, the Commission held an executive session.
  
• The open meeting previously scheduled for February 9 was cancelled.
  

ADMINISTRATIVE FINES

The Commission made public two campaign finance enforcement matters that were resolved through its Administrative Fines (AF) program, as follows. For more information, see the case documents in theEnforcement Query System.

AF 3086

Annette Teijeiro for Congress and Annette Teijeiro, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $1,090.

AF 3118

Brian Sims for Congress and Andrea Lawful Sanders, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $321.

AUDITS

• Proposed Final Audit Report on the Conservative Campaign Committee. On February 8, the Commission approved the Proposed Final Audit Report on the Conservative Campaign Committee, covering campaign finance activity between April 5, 2011, and December 31, 2012. The Commission approved findings related to the reporting of apparent independent expenditures and recordkeeping for communications.
  
• Audit Division Recommendation Memorandum on the Kansas Democratic Party. On February 8, the Commission approved the Audit Division Recommendation Memorandum on the Kansas Democratic Party covering campaign finance activity between January 1, 2011, and December 31, 2012. The Commission approved findings related to the misstatement of financial activity, recordkeeping for employees, reporting of debts and obligations, and Levin Funds activity.
  
• Audit Division Recommendation Memorandum on Kind for Congress Committee. On February 8, the Commission approved the Audit Division Recommendation Memorandum on the Kind for Congress Committee, covering campaign finance activity between January 1, 2013, and December 31, 2014. The Commission approved findings related to the untimely deposit of receipts.
  

LITIGATION

• CREW, et al. v. FEC (Case 16-5300 & 16-5343). On February 6, the Commission filed its Reply in Support of Its Motion to Dismiss Appeal for Lack of Jurisdiction in the United States Court of Appeals for the District of Columbia Circuit.
  
• Independence Institute v. FEC (Case 16-743). On January 9, the Chamber of Commerce of the United States filed a Brief of Amicus Curiae in Support of Appellant's Jurisdictional Statement in the United States Supreme Court. On the same day, Free Speech Defense and Education Fund, Free Speech Coalition, United States Justice Foundation, Gun Owners Foundation, Gun Owners of America, National Right to Work Committee, U.S. Constitutional Rights Legal Defense Fund, Conservative Legal Defense and Education Fund, Downsize DC Foundation, and DownsizeDC.org filed a Brief of Amicus Curiae and Constitutional Law, Political Science, and Economics Professors filed a Brief of Amicus Curiae in Support of Noting Probable Jurisdiction.
  
• Level the Playing Field, et al. v. FEC (Case 1:15-cv-01397-TSC). On February 6, the Commission filed a Motion for Clarification, Reconsideration, and/or Partial Extension of Time in the District Court for the District of Columbia. On February 9, the Plaintiffs filed a Partial Opposition to Defendant’s Motion for Clarification, Reconsideration, and/or Partial Extension of Time, and Motion for Clarification or Reconsideration. On February 10, the District Court issued an Order.
  
• Republican Party of Louisiana, et al. v. FEC (Case 16-865). On February 9, Public Citizen, Inc., Democracy 21, and Campaign Legal Center filed a Brief of Amici Curiae in Support of Appellee and Summary Affirmance in the United States Supreme Court.
  

OUTREACH

• On February 4, Commissioner Ellen L. Weintraub addressed the 2017 Bryce Harlow Workshop on Ethics and Lobbying at American University in Washington, DC.
  
• On February 8, Commissioner Weintraub testified before the Washington Senate’s State Committee in favor of SB 5570, a bill that would require corporations that wish to spend in politics to certify that they are not majority-owned by foreign nationals.
  
• On February 8, Commissioner Weintraub spoke to Prof. Sanne Knudsen’s Administrative Law class at the University of Washington School of Law in Seattle.
