The Real Truth About Obama, Inc. v. FEC and U.S. Department of Justice

On October 1, 2008, the U.S. Court of Appeals for the Fourth Circuit denied The Real Truth About Obama, Inc.’s (RTAO) motion for an injunction pending appeal and motion to expedite consideration of the case.

In July 2008, RTAO, a nonprofit "527" corporation, filed a complaint in the U.S. District Court for the Eastern District of Virginia challenging the constitutionality of three Commission regulations and an FEC "enforcement policy." In September 2008, the district court denied RTAO's motions for preliminary injunctions against the FEC and the Department of Justice.
