FEC Issues Advisory Opinion

WASHINGTON — The Federal Election Commission today issued an Advisory Opinion concerning whether an authorized committee of a federal candidate may raise contributions subject to a separate contribution limit for a primary election ordered by a federal court.

Advisory Opinion 2016-09 (Martins for Congress)

The Commission concluded that Martins for Congress may raise primary contributions subject to a new contribution limit for a primary ordered by a federal court to be held on October 6, 2016, because, under the Federal Election Campaign Act of 1971, as amended (the Act), and Commission regulations, the October 6, 2016, election is a different election from the June 28, 2016, election that was originally scheduled.

The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House of Representatives, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.
