FEC appoints James D. McGinley Associate General Counsel for Litigation

WASHINGTON – The Federal Election Commission has appointed James D. McGinley Associate General Counsel for Litigation, effective Monday, January 13. Mr. McGinley will oversee the Office of General Counsel’s Litigation Division, which represents the Commission before the federal district courts and courts of appeal in all civil litigation involving the campaign finance statutes. The Litigation Division also assists the Solicitor General’s office at the Department of Justice when Commission cases are before the U.S. Supreme Court.

Mr. McGinley has more than 25 years of civil litigation experience in both the private and federal sectors. In his most recent position, he served as an Administrative Appeals Judge for the Employees’ Compensation Appeals Board at the Department of Labor, receiving the U.S. Secretary of Labor’s Honor Award for Exceptional Professional Achievement in 2021 and 2022. Prior to that, Mr. McGinley worked as an Administrative Appeals Judge and then Chairman and Chief Administrative Appeals Judge for the Labor Department ‘s Administrative Review Board.

In his various previous roles, Mr. McGinley served as a lead litigation partner, which included directing law office staff and managing a high volume and complex litigation case load. He earned his law degree from the Pepperdine University School of Law and his LL.M. from Georgetown Law Center.

The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House of Representatives, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.
