District Court issues opinion and order in Free Speech for People, et al. v. FEC
WASHINGTON – The U.S. District Court for the District of Columbia issued a Memorandum Opinion and Order in Free Speech for People, et al. v. FEC (Case No. 22-666) today, granting the Commission’s Motion to Dismiss and dismissing Plaintiffs’ Complaint for Declaratory and Injunctive Relief in its entirety.
In 2022, Plaintiffs filed suit in the U.S. District Court for the District of Columbia alleging that the FEC’s dismissal of the plaintiffs’ administrative complaint in MUR 7207 was contrary to law. The court held that the Commission’s dismissal of the complaint was a proper exercise of the agency’s prosecutorial discretion.
The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House of Representatives, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.
