District Court issues opinion and order in Democratic National Committee, et al. v. Donald J. Trump, et al. (Case No. 25-587)

WASHINGTON – The U.S. District Court for the District of Columbia on Tuesday issued a Memorandum Opinion and Order in Democratic National Committee, et al. v. Donald J. Trump, et al. (Case No. 25-587), granting defendants’ motions to dismiss for lack of a concrete and imminent injury and denying as moot the plaintiffs’ motion for preliminary injunction.

Plaintiffs filed suit in the district court in February challenging Section 7 of Executive Order 14215, which plaintiffs contend undermines the Commission’s independence by purporting to provide the President “with the ability to order the FEC to take particular positions on any question of law arising in the Commission’s performance of any of its duties.”

The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House of Representatives, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.
