The complaint alleged that the Geoff Davis for Congress Committee accepted excessive contributions from Bill Shehan, Jr. and Charles DeLaudrantey in the form of contributions from their minor children that allegedly should have been attributed to their parents. The Commission found no reason to believe that Mr. DeLaudrantey violated the law after receiving his response and affidavits from his children attesting that the contributions were made knowing and willfully from their own funds. The Commission found that Mr. Shehan made excessive contributions to the Committee totaling $2,000 in the names of his minor children and he agreed to pay a civil penalty. The Commission dismissed this matter with regard to his daughters Georgia and Susan Shehan. The Commission found that the Committee failed to properly report correct contributor information for Georgia Shehan and the committee agreed to pay a civil penalty. |

The complaint alleged the Conz-Diaz Champion Racing (“CDC Racing”) fielded a stock car bearing advertising for the Bush-Cheney candidacy in the NASCAR Busch Grand National racing series. The complaint also states the CDC is a business and it offered the Bush-Cheney campaign free or discounted advertising which would make is a prohibited in-kind contribution. The response from CDC Racing believed it had not violated any federal election laws because it “did not give anything away.” The Commission found reason to believe that CDC violated the law by placing the “Bush-Cheney ’04 logo on the car but used its prosecutorial discretion to take no further action because CDC is essentially defunt and the impact of the expenditure was limited. |
