Chief Justice grants emergency stay in CREW v. FEC (16-0259)
On September 15, 2018, Chief Justice of the United States John Roberts granted a stay of the district court decision in CREW v. FEC pending further order of the Chief Justice or the Court, in response to intervenor-defendant Crossroads GPS’s request for a stay pending appeal. The district court’s decision would have vacated an FEC regulation on reporting of independent expenditures by persons other than political committees, effective September 17.
Chief Justice Roberts’s order came shortly after a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit denied a similar motion Crossroads GPS had filed with that court.
As a result of the Chief Justice’s order, 11 CFR 109.10(e)(1)(vi) remains in force until further notice.
