Campaign Legal Center, et al. v. FEC alleges failure to act on complaint (20-0730)

On March 13, 2020, the Campaign Legal Center and Democracy 21 (plaintiffs) filed suit against the FEC in the United States District Court for the District of Columbia (the court). The plaintiffs seek injunctive and declaratory relief under the Federal Election Campaign Act (the Act).

Background

According to the court complaint, on May 27, 2015, plaintiffs filed an administrative complaint with the Commission, alleging that former Florida Governor Jeb Bush had violated 52 U.S.C. § 30125(e) by establishing, financing, maintaining and controlling the Right to Rise Super PAC, which raised and spent funds outside the limitations and prohibitions of the Act.

Plaintiffs request that the court declare that the FEC's failure to act on their administrative complaint was contrary to law and that the Commission has unlawfully withheld and unreasonably delayed agency action on plaintiffs’ administrative complaints under 5 U.S.C. § 706(1). Plaintiffs ask the court to order the FEC to conform with that declaration within 30 days.
