Anna Paulina Luna for Congress v. FEC alleges failure to act on complaint (21-1213)

On May 4, 2021, Anna Paulina Luna for Congress (plaintiff) filed suit against the FEC in the United States District Court for the District of Columbia (the court). The plaintiff seeks injunctive and declaratory relief under the Federal Election Campaign Act (the Act).

Background

Plaintiff is the authorized candidate committee of Congressional candidate Anna Paulina Luna. According to the court complaint, plaintiff filed an administrative complaint with the FEC on October 22, 2020, alleging that Twitter, Inc., violated the Act by verifying opposing candidates’ accounts while refusing to verify Ms. Luna’s. Plaintiff states that, among other things, accounts that are verified by Twitter convey credibility, have a demonstrably higher monetary value and automatically jump to the top of search results. Plaintiff alleges that in refusing to verify Ms. Luna’s account, Twitter has violated the Act’s prohibition on corporate contributions by providing something of value to certain candidates but not to the plaintiff.

The plaintiff asks the court to declare that the FEC has acted contrary to law by failing to act on the administrative complaint, and to order the FEC to conform with that declaration within 30 days.
