AB PAC v. FEC alleges failure to act on complaint (22-2139)

On July 20, 2022, AB PAC filed suit in the U.S. District Court for the District of Columbia alleging the FEC failed to act on its administrative complaint. AB PAC seeks injunctive and declaratory relief under the Federal Election Campaign Act (the Act).

Background

According to the court complaint, AB PAC filed an administrative complaint with the FEC in March 2022 against former president Donald J. Trump. AB PAC states the administrative complaint alleges that Mr. Trump violated the Act by making expenditures to advance a 2024 presidential bid without filing a Statement of Candidacy with the Commission or disclosing those expenditures, and by receiving excessive contributions from a leadership PAC and a joint fundraising committee.

AB PAC asks the court to declare the Commission’s failure to act on its administrative complaint contrary to law and order the FEC to conform to such declaration within 30 days.
