COMPLAINANT:

SUBJECT: Contributions-Prohibited; Contributions-Limitations; Contributions-Corporations

DISPOSITION: The Commission decided by a vote of 5-0 to take the following actions in MUR 8245:1. Accept the conciliation agreement with McSally PAC and Paul Kilgore in his official capacity as treasurer, as recommended in the Memorandum to the Commission dated January 6, 2025. 2. Approve the appropriate letter. 3. Close the file effective 30 days after the date the certification of this vote is signed (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).
The Commission decided by a vote of 6-0 to take the following actions in RAD Referral 22L-21:1. Open a Matter Under Review.2. Find reason to believe that McSally PAC and Paul Kilgore in his official capacity as treasurer violated 52 U.S.C. § 30116(f) and 11 C.F.R. § 110.9 by knowingly accepting excessive contributions.3. Find reason to believe that McSally PAC and Paul Kilgore in his official capacity as treasurer violated 52 U.S.C. § 30118(a) and 11 C.F.R. § 114.2(d) by knowingly accepting prohibited corporate contributions.4. Find no reason to believe that McSally PAC and Paul Kilgore in his official capacity as treasurer violated 11 C.F.R. § 103.3(b) by knowingly accepting contributions from unregistered organizations without ascertaining whether the underlying funds complied with the limitations and prohibitions of the Act.5. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated February 21, 2024, subject to the edits as last circulated by Vice Chair Weintraub’s Office on Wednesday, April 17, 2024 at 11:50 a.m.6. Authorize pre-probable cause conciliation with McSally PAC and Paul Kilgore in his official capacity as treasurer.7. Approve the proposed conciliation agreement, as recommended in the First General Counsel’s Report dated February 21, 2024.8. Approve the appropriate letter
