DISPOSITION: The Commission decided by a vote of 5-1 to take the following actions in MUR 8238:1. Dismiss the allegation that Rafael Edward “Ted” Cruz violated 52 U.S.C. § 30125(e)(1)(A) and 11 C.F.R. § 300.61 by soliciting, receiving, directing, transferring, or spending funds not subject to the limitations, prohibitions, and reporting requirements of the Act in connection with a federal election. 2. Dismiss the allegation that Truth and Courage PAC and Kris Ozanus in their official capacity as treasurer failed to properly report contributions from iHeart Media Inc. in violation of 52 U.S.C. § 30104(b) and 11 C.F.R. § 104.3(a).3. Approve the proposed Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 19, 2024. 4. Approve the appropriate letters. 5. Close the file effective 30 days from the date the certification of this vote is signed (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).
