DISPOSITION: The Commission failed by a vote of 2-4 to:a. Find reason to believe that Last Best Place PAC and David M. Lewis in his official capacity as treasurer violated 52 U.S.C. § 30104(b) and (g) and 11 C.F.R. §§ 104.3(b)(3)(vii), 104.4(a), (b)(2) by failing to disclose independent expenditures on its regularly scheduled reports and by failing to file 48-hour reports of independent expenditures with respect to the ads specifically referenced in the Complaint.b. Direct the Office of General Counsel to circulate and Investigative Plan pursuant to Directive 74 following the receipt of a response to the Reason-to-Believe letter or in the event it appears no response will be made.c. Direct the Office of General Counsel to draft a streamlined Factual and Legal Analysis consistent with finding (a) and the discussion at the table (noting that the Office of General Counsel should remove the discussion of “Not for Sale” ad and rely on the analysis of the relevant ads under 100.22(b)).d. Approve the appropriate letters.
The Commission decided by a vote of 4-2 to:a. Dismiss the complaints.b. Close the file effective 30 days after the date the certification of this vote is signed (or on the next business day after 30th day, if the 30th day falls on a weekend or holiday).c. Send the appropriate letters.
