DISPOSITION: The Commission decided by a vote of 4-2 to take the following actions in MUR 8134:1. Dismiss the allegation that We the People Leadership PAC and Taylor Moose in her official capacity as treasurer failed to report disbursements for text messages as independent expenditures in violation of 52 U.S.C. § 30104(b)(4)(H), (g) and 11 C.F.R. §§ 104.3 and 104.4. 2. Dismiss the allegation that We the People Leadership PAC and Taylor Moose in her official capacity as treasurer made, and that Lauren Boebert and Lauren Boebert for Congress and Taylor Moose in her official capacity as treasurer knowingly accepted, an excessive in-kind contribution in violation of 52 U.S.C. § 30116(a), (f) in connection with the text messages disseminated by We the People Leadership PAC and Taylor Moose in her official capacity as treasurer. 3. Dismiss the allegation that We the People Leadership PAC and Taylor Moose in her official capacity as treasurer made and Lauren Boebert for Congress and Taylor Moose in her official capacity failed to report the expenditures for text messages as an in-kind contribution in violation of 52 U.S.C. § 30104(b) and 11 C.F.R. § 104.13. 4. Approve the proposed Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated May 21, 2024, subject to the edits last circulated by Chairman Cooksey’s Office on Thursday, June 20, 2024 at 3:35 p.m.5. Approve the appropriate letters. 6. Close the file effective 30 days from the date of certification of this vote (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).
