DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 8125:1. Dismiss the allegations that the DCCC and Julie Merz in her official capacity as treasurer violated 52 U.S.C. § 30116(f) and 52 U.S.C. § 30125(a)(1) by making disbursements for impermissible purposes from its recounts and other legal proceedings account under 52 U.S.C. § 30116(a)(9)(C) to the Elias Law Group for “RECOUNT LEGAL SVCS”.2. Dismiss the allegation that DCCC and Julie Merz in her official capacity as treasurer violated 52 U.S.C. § 30104(b) by misreporting the purpose of disbursements to the Elias Law Group. 3. Dismiss the allegation that the Elias Law Group violated 52 U.S.C. § 30116(f) and 52 U.S.C. § 30125(a)(1) by receiving disbursements from the DCCC’s recounts and other legal proceedings account under 52 U.S.C. § 30116(a)(9)(C) for “RECOUNT LEGAL SVCS”. 4. Approve the attached Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated July 5, 2024, subject to the edits circulated by Vice Chair Weintraub’s Office on behalf of the Democratic Commissioners on August 7, 2024 at 11:31 a.m.5. Approve the appropriate letters. 6. Close the file effective 30 days from the date of certification of this vote (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).
