DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 8107:1. Accept the signed Conciliation Agreement with Mike Braun for Indiana, as recommended in the Memorandum to the Commission dated February 9, 2024.2. Approve the appropriate letters.3. Close the file.
The Commission decided by a vote of 4-0 to take the following actions in MUR 8107:1. Reject Mike Braun for Indiana's redlined counteroffer of ...REDACTED...dated July 25, 2023.2. Authorize the Office of General Counsel to make a conciliation counteroffer for a penalty in the amount of ...REDACTED...3. Instruct the Office of General Counsel to inform the respondent that this is the Commission's best and final offer and that it will not accept any lower penalty amount in the conciliation agreement.4. Authorize the Office of General Counsel to engage in conciliation negotiations for a period not to exceed 30 days from the date of the vote certification and inform the respondent that conciliation has been so limited.

Approve the revised Factual and Legal Analysis for Mike Braun for Indiana and Thomas Datwyler in his official capacity as treasurer, as recommended in the Memorandum to the Commission dated February 9, 2023, subject to the edits set forth in Mr. Olaya’s email on behalf of Chair Lindenbaum and Commissioners Broussard and Weintraub on February 16, 2023, at 9:39 p.m.2. Approve the revised Conciliation Agreement for Mike Braun for Indiana and Thomas Datwyler in his official capacity as treasurer, as recommended in the Memorandum to the Commission dated February 9, 2023, subject to the edits set forth in Mr. Olaya’s email on behalf of Chair Lindenbaum and Commissioners Broussard and Weintraub on February 16, 2023, at 9:39 p.m.

Find reason to believe that Mike Braun for Indiana and Thomas Datwyler in his official capacity as treasurer failed to properly disclose loans in violation of 52 U.S.C. § 30104(b)(8) and 11 C.F.R. § 104.3(d)(4).c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated December 21, 2022, and further direct the Office of General Counsel to make conforming edits to reflect the Commission’s findings.d. Authorize pre-probable cause conciliation with Mike Braun for Indiana and Thomas Datwyler in his official capacity as treasurer.e. Approve the proposed conciliation agreement, as recommended in the First General Counsel’s Report dated December 21, 2022, and further direct the Office of General Counsel to make conforming edits to reflect the Commission’s findings.f. Approve the appropriate letters.
The Commission failed by a vote of 3-3 to:Dismiss as an exercise of prosecutorial discretion allegations that Mike Braun for Indiana and Thomas Datwyler in his official capacity as treasurer failed to accurately report receipts and disbursements in violation of 52 U.S.C. § 30104(b)(2) and (4) and 11 C.F.R. § 104.3(a) and (b).
