DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 8091:1. Accept the Conciliation Agreement with Beth Harwell, Beth Harwell (House 18), and Tennesseans for Good State Government, as recommended in the Memorandum to the Commission dated February 23, 2024.2. Approve the appropriate letters.3. Close the file effective 30 days after the date the certification of this vote is signed (or on the next business day after the 30th day, if the 30th day falls on a weekend or holiday).
The Commission failed by a vote of 3-3 to:a. Find reason to believe that Beth Harwell, the Beth Harwell (House 18), and Tennesseans for Good State Government violated 52 U.S.C. § 30125(e)(1)(A) by transferring funds not subject to the limitations, prohibitions, and reporting requirements of the Act in connection with an election for federal office. b. Find reason to believe that Government of the People and Debra Y. Maggart in her official capacity as treasurer violated 52 U.S.C. § 30125(e)(1)(A) by receiving funds in connection with an election for federal office that were not subject to the limitations, prohibitions, and reporting requirements of the Act. c. Approve the attached Factual and Legal Analyses, as recommended in the First General Counsel’s Report dated October 17, 2023. d. Authorize pre-probable cause conciliation with Beth Harwell, the Beth Harwell (House 18), Tennesseans for Good State Government, and Government of the People and Debra Y. Maggart in her official capacity as treasurer. e. Approve the proposed Conciliation Agreements, as recommended in the First General Counsel’s Report dated October 17, 2023. f. Approve the appropriate letters.

Authorize pre-probable cause conciliation with Beth Harwell, the Beth Harwell (House 18), and Tennesseans for Good State Government.d. Approve the draft Conciliation Agreements, as recommended in the First General Counsel’s Report dated October 17, 2023, for those respondents as last circulated by Vice Chairman Cooksey’s Office, subject to the edits last circulated by Vice Chairman Cooksey’s Office.
