DISPOSITION: The Commission decided by a vote of 4-1 to take the following actions in MUR 8070: 1. Accept the conciliation agreement, as recommended in the Memorandum to the Commission dated November 9, 2022. 2. Approve the appropriate letter. 3. Close the file.
The Commission failed by a vote of 1-4 to: Transfer the matter to the Office of Alternative Dispute Resolution.
The Commission failed by a vote of 2-3 to: a. Open a MUR in RR 22L-07. b. Find reason to believe that the Democratic Executive Committee of Florida and Fran Garcia in her official capacity as treasurer violated 52 U.S.C. § 30104(b)(8) and 11 C.F.R. § 104.3(d) by failing to report additional incurred debts. c. Find reason to believe that the Democratic Executive Committee of Florida and Fran Garcia in her official capacity as treasurer violated 52 U.S.C. § 30116(f) and 11 C.F.R. §§ 103.3(b)(3), 110.9 by accepting excessive contributions. d. Find reason to believe that the Democratic Executive Committee of Florida and Fran Garcia in her official capacity as treasurer violated 52 U.S.C. § 30118(a) and 11 C.F.R. §§ 103.3(b), 110.4(c)(3), 110.9 by accepting prohibited contributions. e. Find reason to believe that the Democratic Executive Committee of Florida and Fran Garcia in her official capacity as treasurer violated 52 U.S.C. §§ 30116(f) and/or 30118(a) and 11 C.F.R. § 103.3(b) by accepting an excessive and/or prohibited contribution from an unregistered organization. f.
