COMPLAINANT:
SUBJECT: Committees-Candidate; Personal use; Reporting
DISPOSITION: The Commission decided by a vote of 5-1 to take the following actions in MUR 8069:
1. Accept the signed Conciliation Agreement, as recommended in the Memorandum to the Commission dated February 8, 2023.
2. Dismiss the allegations that Warren Christopher and Friends of Warren Christopher and Leticia C. Smith in her official capacity as treasurer violated 52 U.S.C. § 30114(b) and 11 C.F.R, § 113.21(g) by converting campaign funds to personal use.
3. Approve the appropriate letters.
4. Close the file.
The Commission decided by a vote of 4-1 to take the following actions in MUR 8069:
1. Approve the revised Factual and Legal Analysis, as recommended in the Memorandum to the Commission dated September 22, 2022.
2. Approve the proposed Conciliation Agreement, as recommended in the Memorandum to the Commission dated September 22, 2022.
3. Approve the appropriate letter.
The Commission failed by a vote of 3-3 to:
a. Open a MUR.
b. Find reason to believe that Friends of Warren Christopher and Leticia C. Smith in her official capacity as treasurer violated 52 U.S.C. § 30104(a), (b) and 11 C.F.R. §§ 104.1(a), 104.3 by failing to file disclosure reports disclosing cash on hand, receipts, and disbursements.
c. Take no action at this time as to whether Warren Christopher and Friends of Warren Christopher and Leticia C. Smith in her official capacity as treasurer and Warren Christopher violated 52 U.S.C. § 30114(b) and 11 C.F.R. § 113.1(g) by converting campaign funds to personal use.
d. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated August 24, 2022.
e. Authorize the use of compulsory process, as recommended in the First General Counsel’s Report dated August 24, 2022.
f. Approve the subpoena to PNC Bank, as recommended in the First General Counsel’s Report dated August 24, 2022.
g. Approve the appropriate letters.
The Commission decided by a vote of 5-1 to:
a. Open a MUR.
b. Find reason to believe that Friends of Warren Christopher and Leticia C. Smith in her official capacity as treasurer violated 52 U.S.C. § 30104(a), (b) and 11 C.F.R. §§ 104.1(a), 104.3 by failing to file disclosure reports disclosing cash on hand, receipts, and disbursements.
c. Take no action at this time as to whether Warren Christopher and Friends of Warren Christopher and Leticia C. Smith in her official capacity as treasurer and Warren Christopher violated 52 U.S.C. § 30114(b) and 11 C.F.R. § 113.1(g) by converting campaign funds to personal use.
d. Authorize pre-probable cause conciliation with Friends of Warren Christopher and Leticia C. Smith in her official capacity as treasurer and Warren Christopher.
e. Direct the Office of General Counsel to draft an appropriate Conciliation Agreement . . . REDACTED . . .
f. Direct the Office of General Counsel to make conforming edits to the Factual and Legal Analysis and circulate to the Commission for approval.
