DISPOSITION: The Commission decided by a vote of 5-1 to take the following actions in MUR 8031: 1. Accept the conciliation agreement, as recommended in the Memorandum to the Commission dated October 7, 2022. 2. Approve the appropriate letter. 3. Close the file.
The Commission failed by a vote of 3-3 to: a. Open a MUR. b. Find reason to believe that the Hawaii Republican Party and Stephen C. Holck in his official capacity as treasurer violated 52 U.S.C. § 30104(b)(2), (4) and 11 C.F.R. §§ 104.3(a), (b); 102.17(c). c. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated December 14, 2021. d. Authorize pre-probable cause conciliation with the Hawaii Republican Party and Stephen C. Holck in his official capacity as treasurer. e. Approve the Conciliation Agreement, as recommended in the First General Counsel’s Report dated December 14, 2021. f. Approve the appropriate letter.
The Commission failed by a vote of 3-3 to: Reject the Office of General Counsel’s recommendations, and instead refer the matter to the Alternative Dispute Resolution Office.
