DISPOSITION: The Commission decided by a vote of 6-0 to take the following actions in MUR 7987:
1. Take no further action as to the allegation Phil Rizzo for Congress and David Satterfield in his official capacity as treasurer violated 52 U.S.C. § 30120 and 11 C.F.R.
§ 110.11 by failing to include required disclaimers on public communications.
2. Approve the appropriate letters.
3. Close the file.
The Commission decided by a vote of 6-0 to approve the Order to Submit Written Answer to Phil Rizzo for Congress, as recommended in the Memorandum to the Commission dated February 6, 2023, and subject to the edits to the interrogatories as last circulated by Vice Chairman Cooksey’s Office on Monday, February 27, 2023 at 3:14 p.m.
The Commission failed by a vote of 3-3 to:
a. Find reason to believe that Phil Rizzo for Congress and David Satterfield in his official capacity as treasurer violated 52 U.S.C. § 30120 and 11 C.F.R. § 110.11 by failing to include required disclaimers on public communications.
b. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 3, 2022, . . . REDACTED . . .
c. Enter into conciliation with Phil Rizzo for Congress and David Satterfield in his official capacity as treasurer prior to a finding of probable cause to believe.
d. Approve the conciliation agreement, as recommended in the First General Counsel’s Report dated November 3, 2022.
e. Approve the appropriate letter.
The Commission decided by a vote of 6-0 to:
a. Find reason to believe that Phil Rizzo for Congress and David Satterfield in his official capacity as treasurer violated 52 U.S.C. § 30120 and 11 C.F.R. § 110.11 by failing to include required disclaimers on public communications.
b. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 3, 2022, and subject to the edits last circulated by Commissioner Trainor’s Office on January 20, 2023 at 9:13 a.m.
c. Authorize compulsory process, subject to the discussion at the table about the scope of interrogatories.
d. Approve the appropriate letter.
