DISPOSITION: The Commission failed by a vote of 2-4 to: a. Find reason to believe that Lou Barletta and Mary Grace Barletta violated 52 U.S.C. § 30116(a)(1)(C) by making excessive contributions to Leaders Only Unite Political Action Committee (AKA LOU PAC) and Robert Carlin in his official capacity as treasurer. b. Find reason to believe that Leaders Only Unite Political Action Committee (AKA LOU PAC) and Robert Carlin in his official capacity as treasurer violated 52 U.S.C. § 30116(f) by accepting excessive contributions from Lou Barletta and Mary Grace Barletta and violated 52 U.S.C. § 30104(b) by failing to report the contributions. c. Find reason to believe that Leaders Only Unite Political Action Committee (AKA LOU PAC) and Robert Carlin in his official capacity as treasurer violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use. d. Find reason to believe that Lou Barletta and Mary Grace Barletta violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use. e. Find reason to believe that Yankee PAC and Nancy Watkins in her official capacity as treasurer (terminated) violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use. f. Direct the Office of General Counsel to draft an appropriate Factual and Legal Analysis consistent with these findings. g. Authorize the use of compulsory process. h. Approve the appropriate letters.
The Commission decided by a vote of 4-2 to: a. Find no reason to believe that Lou Barletta and Mary Grace Barletta violated 52 U.S.C. § 30116(a)(1)(C) by making excessive contributions to Leaders Only Unite Political Action Committee (AKA LOU PAC) and Robert Carlin in his official capacity as treasurer. b. Find no reason to believe that Leaders Only Unite Political Action Committee (AKA LOU PAC) and Robert Carlin in his official capacity as treasurer violated 52 U.S.C. § 30116(f) by accepting excessive contributions from Lou Barletta and Mary Grace Barletta and violated 52 U.S.C. § 30104(b) by failing to report the contributions. c. Find no reason to believe that Leaders Only Unite Political Action Committee (AKA LOU PAC) and Robert Carlin in his official capacity as treasurer violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use. d. Find no reason to believe that Lou Barletta and Mary Grace Barletta violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use. e. Find no reason to believe that Yankee PAC and Nancy Watkins in her official capacity as treasurer (terminated) violated 52 U.S.C. § 30114(b) by converting campaign funds to personal use. f. Approve the Factual and Legal Analysis, as recommended in the First General Counsel’s Report dated November 1, 2022, subject to the edits circulated by Vice Chairman Cooksey’s Office on Thursday, January 19, 2023 at 12:20 p.m., and further subject to the technical edit discussed at the table by the Office of General Counsel. g. Approve the appropriate letters. h. Close the file.
